About these terms.

These Terms and Conditions apply to your use of the INKMYWEAR website and to orders where these terms are incorporated into the purchase.

By placing an order, you confirm that you accept the terms that apply to your purchase together with relevant policies referred to during the ordering process.

Nothing in these terms is intended to exclude, restrict or limit legal rights that cannot lawfully be excluded.

INKMYWEAR provides personalised clothing and related products through its online store.

Products and personalisation.

We make reasonable efforts to describe and present products accurately. Colours and appearance may vary depending on screens, garment batches and reasonable production variations.

Product availability, sizes, colours and personalisation options can vary between items.

Before ordering personalised clothing, you are responsible for reviewing the information submitted for your design.

• Names, wording, dates and spelling.
• Uploaded artwork, images and graphics.
• Selected garment, size and colour.
• Available design placement and personalisation options.

Where a digital preview is available, it should be used as a general guide. The finished item may have reasonable production variations.

Customer artwork and submitted content.

You must have the necessary rights and permissions to use any artwork, photograph, logo, wording or other material submitted for personalisation.

By submitting content, you confirm that using it to produce your order does not unlawfully infringe another person's intellectual property or other legal rights.

We may refuse or cancel an order where submitted content is unlawful, cannot reasonably be produced or is reasonably believed to infringe third-party rights.

Orders, prices and payments.

Order acceptance

Submitting an order is an offer to purchase the selected products using the information supplied during checkout.

An automated acknowledgement does not necessarily mean an order has been accepted for production.

We may be unable to accept or fulfil an order because of product availability, unsuccessful payment, an obvious pricing error, submitted content or another reasonable fulfilment issue.

Prices and charges

The amount payable is the price confirmed through checkout, subject to the correction of obvious errors. Applicable delivery charges and available discounts will be shown where relevant.

Payment

Available payment methods are those shown during checkout. Depending on availability, these may include PayPal, cryptocurrency payments processed through NOWPayments and direct bank transfer.

Cryptocurrency transactions must use the supported currency and network shown during the payment process. Bank transfer orders may remain on hold until cleared funds are received and identified.

Payment confirmation may be required before a personalised order moves into production.

Production and delivery.

Personalised items are prepared for the confirmed order. Production normally begins after relevant order and payment requirements have been satisfied.

Production time and carrier delivery time are separate stages of the order process.

Available delivery services, charges and estimated timelines are shown where applicable during checkout or through our delivery information.

Unless a delivery date has been expressly confirmed as guaranteed, displayed delivery times should be treated as estimates.

Customers are responsible for providing a complete and accurate delivery address. Tracking information may be provided where the selected service supports tracking.

Changes, cancellations, returns and faults.

Changes to personalised orders

Contact us as soon as possible if you need to request an order change. We cannot guarantee that changes will be possible after an order has been submitted or production has begun.

Change-of-mind cancellations

Goods made to your specifications or clearly personalised may be subject to different change-of-mind cancellation rights from standard non-personalised goods.

Where statutory cancellation rights apply to a non-personalised item, these terms do not remove those rights.

Faulty, damaged or incorrect products

Contact us promptly if an item is faulty, damaged, incorrect or does not match the confirmed order.

We may request your order details, a description of the issue, photographs and other reasonable information needed to review the matter.

Nothing in our returns process is intended to reduce statutory rights relating to goods that do not meet applicable legal requirements.

Print promise, sizing and garment care.

Certain eligible products may be supported by the published 50-Wash Promise, subject to the stated eligibility requirements, care conditions, exclusions and review process.

The commercial promise is additional to, and does not replace or reduce, any statutory consumer rights that may apply.

Customers should review the relevant product sizing information before ordering because garment measurements can vary between products.

Personalised clothing should be cared for according to the garment label and applicable product-specific guidance.

Intellectual property.

Unless otherwise stated, the INKMYWEAR website, branding, original website content, graphics and other materials created by or for us are protected by applicable intellectual property laws.

Website content may be used for personal and lawful shopping purposes. Protected materials must not be commercially reproduced, distributed or exploited without appropriate permission except where permitted by law.

Ownership of customer-supplied artwork remains with the relevant rights holder. Submitting artwork gives us permission to use it as reasonably necessary to process, produce and support the relevant order.

Privacy and personal information.

Personal information is handled in accordance with our published Privacy Policy and applicable data protection requirements.

Information may be processed where reasonably necessary to manage orders, payments, fulfilment, delivery and customer support.

Third-party payment and service providers may process information under their own applicable privacy terms.

Liability and general provisions.

Our responsibility

Nothing in these terms excludes or limits liability where doing so would be unlawful.

Subject to applicable law, we are responsible for losses that are a foreseeable result of our breach of the contract with you.

Different legal rights and limitations may apply where products are purchased wholly or mainly for business purposes.

Events outside reasonable control

We may not be responsible for a failure or delay caused by circumstances outside our reasonable control, subject to rights that remain available under applicable law.

Changes to these terms

We may update these terms from time to time. The version applicable to an order will generally be the version in force when that order is placed.

Severability and waiver

If any provision is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A delay in enforcing a contractual right does not automatically mean that the right has been waived.

Governing law.

These terms are governed by the laws of England and Wales, subject to mandatory legal protections that may apply to you as a consumer.

Consumers living elsewhere in the United Kingdom may have rights relating to the courts available in the part of the United Kingdom where they live.

Nothing in this section is intended to remove mandatory rights or protections available under applicable law.
